THIS AGREEMENT made at _______________ on this 2026-05-04, BETWEEN

_______________, residing at _______________, hereinafter called the “LESSOR” or “LANDLORD” (which expression shall include heirs and assigns) of the ONE PART

AND

_______________, residing at _______________,hereinafter called the “LESSEE” or “TENANT” (which expression shall include heirs and assigns) of the OTHER PART.

1. Property

The Lessor hereby agrees to lease to the Lessee the following premises (hereinafter the “Premises”): 1 BHK apartment located at _______________.

2. Term

The lease shall commence on 2026-05-04 and continue for a period of 11 (eleven) months, renewable by mutual consent of both parties on the same or revised terms.

3. Rent

The Lessee shall pay a monthly rent of 25,000 (Twenty Five Thousand Rupees Only), payable in advance on or before the 7th of each English calendar month, by bank transfer to the Lessor's designated account.

4. Security Deposit

The Lessee shall deposit a sum of 75,000 (Seventy Five Thousand Rupees Only) as an interest-free refundable security deposit at the time of execution of this agreement. The deposit shall be refunded to the Lessee within 30 days of vacating the Premises, after deducting any unpaid rent, utility dues, and damages beyond normal wear and tear.

5. Maintenance and Utilities

Maintenance charges, water and electricity bills, gas and internet charges shall be paid by the Tenant. Property tax shall be borne by the Lessor.

6. Use of Premises

The Premises shall be used solely for residential purposes and not for any commercial, illegal or unauthorised activity. The Lessee shall not sublet the Premises without prior written consent of the Lessor.

7. Notice to Vacate

Either party may terminate this agreement by providing 1 month written notice. Both parties shall be bound by the lock-in period (if any) as separately agreed.

8. Inspection

The Lessor or his/her representative shall have the right to inspect the Premises with reasonable prior intimation to the Lessee.

9. Alterations

The Lessee shall not make any structural alterations or additions without prior written consent of the Lessor.

10. Jurisdiction

Any disputes arising from this Agreement shall be subject to the jurisdiction of the courts of _______________.

Why 11 months?

The Registration Act, 1908 mandates registration for leases over 12 months. The 11-month convention is a practical workaround: agreements at this duration avoid registration fees and stamp duty in most states. You can renew the agreement at the end of 11 months.

Stamp paper requirements

Most states require the agreement to be printed on non-judicial stamp paper: Karnataka ₹100, Delhi ₹100, Maharashtra ₹500, Tamil Nadu ₹100, Telangana ₹100. Some states accept e-stamp; others require physical stamp paper. Check with a local notary.

Always include in your agreement

  • Monthly rent + escalation (typically 5-10% on renewal)
  • Security deposit (1-3 months in metro, 10 months in BLR is common)
  • Maintenance charges — who pays for what
  • Notice period for vacating (1-3 months)
  • Lock-in period if any
  • Use restriction (residential only, no commercial use)
