Birth certificate in India — registration deadlines and document list

Birth must be registered within 21 days. After 21 days, late fees and delays kick in. Here is the full process for both timely and late registration.

Quick frame: Under the Registration of Births and Deaths Act 1969, every birth in India must be registered within 21 days. The certificate is issued by the municipal corporation / panchayat for the area where the birth occurred. If the birth was in a hospital, the hospital files the form on your behalf — but you must collect the certificate.

Within 21 days (timely registration)

Documents needed:

  1. Birth report from hospital (Form 1)
  2. Parent's Aadhaar
  3. Parent's marriage certificate (some states ask)
  4. Address proof
  5. ID proof of informant (parent)

Fee: ₹0 (free if within 21 days) Processing: 7-14 days

Within 21-30 days (slightly delayed)

Documents same as above + late fee ~₹2-25 (varies by municipality).

Within 30 days - 1 year

  • Affidavit
  • Permission from registrar
  • Late fee ₹25-100
  • Processing 21-30 days

After 1 year (late registration)

  • Order from First Class Magistrate / SDM
  • Affidavit by parents
  • School records, hospital records, vaccination card as proof
  • Penalty fine (varies, ~₹10-100)
  • Processing 30-90 days

Online application

Most municipal corporations now allow online application:

  • BMC (Mumbai): birth.mahaonline.gov.in
  • BBMP (Bengaluru): bbmp.gov.in
  • Chennai Corporation: chennaicorporation.gov.in
  • DMC (Delhi): mcdonline.gov.in
  • KMC (Kolkata): kmcgov.in
  • Government of India consolidated: crsorgi.gov.in

Why birth certificate matters

  • Aadhaar enrolment for newborns (PoB)
  • School admission
  • Passport (DOB proof primary)
  • Government scheme enrolment (Janani Suraksha, kishori shakti)
  • Inheritance / property records

Hospital-issued discharge slip is NOT a birth certificate

The hospital gives you a "Birth Notification" — this is an internal document. The legal birth certificate must come from municipal corporation. Don't conflate them.

Spelling corrections / name addition

Many newborns are registered without a name (parents had not decided). You can:

  • Add the name within 1 year — free, with affidavit
  • After 1 year — gazette notification + magistrate order

Spelling errors: file correction application with affidavit and supporting documents.

FAQ

Q: My parents never registered my birth (born in 1985, rural). Can I still get one? A: Yes — apply for late registration via SDM. Provide school certificate showing DOB, hospital records if available, two reliable witnesses, and an affidavit. Process takes 1-3 months.

Q: Birth abroad — how do I register in India? A: Indian missions abroad register births. Submit application within 1 year via embassy. Otherwise, register within 60 days of returning to India at local registrar.

Q: Adopted child — birth certificate? A: After adoption order, parents apply for revised certificate naming adoptive parents. Original record is preserved confidentially.
